Statement in Support of Deepan Budlakoti and against Double Punishment

Under Canadian immigration law, non-citizens who are convicted of criminal offenses are punished twice: first when they are sentenced for the crime; and a second time by being declared 'inadmissable' and deported from Canada. 
We believe this policy of “double punishment” is unjust. It applies a double-standard and punishes people twice for the same thing. We reject double punishment.

Double punishment is often the direct result of racial profiling. The targeting of racialized and immigrant communities puts a disproportionate number of people of colour in the criminal justice system. This can lead to deportation when people don't have citizenship. We reject racial profiling.

Double punishment reinforces a negative perception of immigrants; implying a link between criminality and immigration. It is a way for jingoistic politicians to win cheap votes. We reject this link as racist and false.

Double punishment, like the rest of immigration law, treats certain people as 'undesirable' or 'disposible'; throwing them out of the country when it no longer has use for them. They are often sent, with few resources, to places where they have little or no connections. We uphold the inviolable dignity of all immigrants.
Double punishment treats other countries, often former colonies, as dumping grounds for its 'deportees'. However, these people are at least in part the product of Canadian society; their choices structured by its racisms, violent exclusions and structural poverty. We believe Canada should take responsibility for its own.

The case of Deepan Budlakoti exposes the injustice of double punishment in an extreme way. Deepan was born in Canada. His entire family lives in Canada. He grew up believing he was a citizen and held a Canadian passport stating he was Canadian. However, an obscure part of Immigration law allowed the Canadian government to contest his citizenship because of his parents' alleged status at his birth and thus, when he got in trouble with the law, to punish him twice for the same thing.

Deepan is now facing deportation to India, where he has never lived, has no family, no ties and of which he has little knowledge. Moroever, India does not recognize him as a citizen and has refused to issue a travel document for him.

Because of this situation, Deepan remains indefinitely under strict conditions, including a curfew and the requirement to live with his parents. He has no status and needs to apply for a work permit in order to work and is denied access to basic social services.

Deepan is a Canadian and a member of our community, and we stand with him as he fights to remain with his family, friends and community in Ottawa and to uphold his full dignity. We reject the unjust and racist policies that seek to dehumanize and throw him out of our community and the country.

We demand that Deepan be immediately released from the conditions imposed on him and that his citizenship be restored to him without delay.

D'après la loi canadienne d'immigration, les non-citoyen-ne-s qui sont condamné-e-s pour un crime sont puni-e-s deux fois : d'abord quand ils ou elles reçoivent une peine criminelle ; puis une deuxième fois quand ils se font déclaré-e-s « inadmissibles » et sont déporté-e-s du Canada. Nous croyons que cette politique de « double peine » est injuste. Elle applique un double standard et punis les gens deux fois pour la même chose. Nous rejetons la double peine.

La double peine est souvent le résultat du profilage racial. Le ciblage des communautés racialisées et immigrantes met un nombre disproportionné de personnes de couleur dans le système de justice criminelle. Ceci peut entraîner la déportation quand les gens n'ont pas la citoyenneté. Nous rejetons le profilage racial.

La double peine renforce une perception négative des immigrantEs; impliquant un lien entre la criminalité et l'immigration. C'est une façon pour les politicienNEs chauvins de gagner des votes faciles. Nous rejetons ce lien comme raciste et faux.

La double peine, comme le reste de la loi sur l'immigration, traite certaines personnes comme « indésirables » ou « jetables »; les jetant hors du pays quand ils n'ont plus d'utilité. Ils sont souvent renvoyés, avec peu de ressources, vers des endroits où ils ont peu ou pas de liens. Nous soutenons la dignité inviolable de touTEs les immigrantEs.

La double peine traite les autres pays, souvent des anciennes colonies, comme des dépotoirs pour ses « déportéEs ». Pourtant, ces personnes sont au moins en partie le produit de la société canadienne; leurs choix sont structurés par ses racismes, exclusions violentes et pauvreté structurelle. Nous croyons que le Canada devrait prendre ses responsabilités pour les sienNEs.

Le cas de Deepan Budlakoti expose l'injustice de la double peine d'une façon extrême. Deepan est né au Canada. Toute sa famille vit au Canada. Il a grandi croyant qu'il était citoyen et avait un passeport canadien qui disait qu'il était Canadien. Pourtant, une partie obscure de la loi sur l'immigration a permis au gouvernement canadien de contester sa citoyenneté à cause du statut allégué de ses parents à sa naissance, et donc, quand il a eu des ennuis avec la loi, il a été puni deux fois pour la même chose.

Deepan fait maintenant face à la déportation vers l'Inde, où il n'a jamais habité, n'a pas de famille, et de laquelle il connaît très peu de choses. De plus, l'Inde ne le reconnaît pas comme un citoyen et a refusé de lui fournir des documents de voyage.

À cause de cette situation, Deepan est pris indéfiniment avec des conditions strictes, dont un couvre-feu et l'obligation de vivre avec ses parents. Il n'a pas de statut et a besoin d'appliquer pour un permis de travail afin de travailler, et il se fait refuser les services sociaux de base.

Deepan est un Canadien et un membre de notre communauté, et nous le soutenons dans sa lutte pour rester avec sa famille, ses amiEs et sa communauté à Ottawa et pour défendre sa dignité. Nous rejetons les politiques injustes et racistes qui visent à le déshumaniser et à le rejeter hors de notre communauté et de notre pays.

Nous demandons que Deepan soit immédiatement libéré des conditions qui lui sont imposées et que sa citoyenneté lui soit rendus sans délais.
